BIHAR RTI ACT UESERS’ SATI SFACTION ATAN ALL.TIME LOW

(i) Since assumption of office by the new Chief Information Commissioner

of State Information Commission on 22.10.2009 in Bihar citizens are facing an all- time low in procurement of their information.

(ii) Instead of providing access to information to citizens in order to promote transparency. Accountability and to fight corruption. Commission is using all Kinds of improper means to deny information to public.

(iii) Citizens already apprehensive in present of commissioner are made to read ‘definition’ of RTI Act during the hearing and then told that information that they seek is not ‘givable’

(iv) Commission is closing pending appeal cases without actually providing information to the public such as when P.I.O untruthfully says he ‘will’ provide information or when appellant is absent.

(v) Overall citizens’ satisfaction with Commission. Which was already low at 31% according to recent survey by public Cause Research Foundation has now plunged further to some where between 0-5% in the last 2 months.

(vi) Although penalty on public information officers (P.I.O) is strictly to be imposed by Commission, they are not imposing any penalty on P. I. Os and requests by citizens to impose penalty are thrown into the dustbin in complete disregard of RTI Act.

(vii) Citizens of Bihar request Government of Bihar to hold an enquiry and social audit, into all such violations against the Act by very people who must protect it, and restore sanctity of Act and sanity into implementation of Act.

(viii) BRIT Manch’s requests to inspect records of the Commission are being met with delays.

(ix) BRTI Manch regrets to say that appointment of Commission seems to have been deliberately done from a section of society who are well- rehearsed, by virtue of their career to keep information from the Public.

Strengthen RTI movement at all levels, says Hamid Ansari

Noting that the Right to Information (RTI) Act has ushered in the beginning of participatory governance, Vice-President Hamid Ansari on Tuesday said the movement must be strengthened at all levels and the support of the government, civil society and citizens was vital for its success.

Delivering the inaugural address at the first “National RTI Awards-2009” organised by Public Cause Research Foundation and NDTV here, Mr. Ansari said: “I must confess that I am pleasantly surprised at the manner in which common citizens across the country have taken recourse to the RTI Act to address their unending efforts to secure justice. The RTI Act has become an instrumentality in the hands of citizens to secure administrative facilitation and grievance redress.”

Pointing out that the Act was the outcome of civil society efforts of over a decade, Mr. Ansari said it was a legislative recognition of the view of the Supreme Court that the right to information was a fundamental right under the Constitution. “It was also an acceptance by the executive that it is answerable to the people not just once in five years but every time an RTI application is filed, which is hundreds of times a day. It has given a new meaning to citizen engagement with governance,” he added.

Expressing satisfaction that the RTI Act had imposed new obligations on all stakeholders, Mr. Ansari said the government was called upon to be more transparent and accountable in decision and policy making, and manage its records better. “The civil society is expected to be an informal clearing house for information to help common citizens understand and use this new instrumentality. This makes possible the participation of citizens in governance beyond elections,” he added.

Mr. Ansari said that the right to information also remains a fundamental right with limited means of justice and ability in comparison to other fundamental rights. “An important lacuna of the Act has been the lack of a mandatory monitoring mechanism to look at the implementation of the Act and to ensure that it is implemented in letter and spirit.”

Awards presented

The best RTI Citizen category award was given to social activist from Assam Akhil Gogoi. “Assam is known for terrorism and ethnic cleansing. The RTI is a big tool to fight draconian laws affecting our State. We have followed a methodology to use the RTI Act for the benefit of society. This methodology involves the RTI application, social scrutiny and people’s movement.”

While Lalit Narayan Mishra from Etawah was presented the award for the Best Public Information Officer, the Arunachal Pradesh Information Commission was awarded in the Best Information Commissioner category.

In his closing address, jurist Fali Nariman, who was part of the jury, said that 50 years ago people couldn’t have imagined that citizens would become activists.

Reversal Sought in RTI Amendments

Dozens of people in Patna on Monday, under the banner of Right to Information Campaign, sat on a daylong dharna to protest the recent amendments in the RTI Act made by the Nitish administration.

Expressing anger over the government's decision to charge a fee for the information, the protestors said such act was undemocratic and was against the true spirit of the Act.

Before the recent amendments, a petitioner could seek information on many issues on a single request but the new rules force the information-seekers to file separate requests for separate documents with a price tag of Rs. 10 each.

Officials, however, cite growing abuse of the RTI Act leading to increased fee in the service.

बिहार में सूचना के अधिकार पर जानकारी नहीं मिल रही

सूचना का अधिकार अधिनियम 2005. बिहार में इस क़ानून के तहत सूचना मांगने वाले लोगों पर भ्रष्ट अधिकारियों के अत्याचार का डंडा बरसने लगा है.

यहाँ पंचायत स्तर से लेकर सरकारी विभागों के स्तर तक इस मामले में प्रताड़ना के कई मामले सामने आ चुके हैं.

सरकारी योजनाओं में बरती गई अनियमितताओं को दबाने-छिपाने वाला अधिकारी या कर्मचारी वर्ग यहाँ लोगों के सूचना-अधिकार के ख़िलाफ़ हमलावर रुख़ अपना चुका है.

बिहार में तीन साल पहले इस अधिनियम को लागू करते समय दिखने वाली सरकारी तत्परता की देश भर में सराहना हुई थी.

आज स्थिति उलट गई लगती है. कारण है कि अब इसी राज्य में नागरिकों के सूचना-अधिकार का हनन सबसे ज़्यादा हो रहा है.

किसी और ऑडियो/वीडियो प्लेयर में चलाएँ

हालत यहाँ तक बिगड़ चुकी है कि भ्रष्टाचार साबित कर देने जैसी सूचना मांगने वालों को झूठे मुक़दमों में फँसाया जा रहा है. ऐसे लोगों को जेल भेज देने की भी धमकी दी जा रही है.

सूचना अधिकार क्षेत्र के जाने माने सामजिक कार्यकर्ता और मैगसेसे पुरस्कार प्राप्त कर चुके अरविंद केजरीवाल ने हाल ही में इस बाबत पटना में मुख्यमंत्री नीतीश कुमार से मुलाक़ात की और उन्होंने हालात में सुधार का अनुरोध किया.

जिस बिहार राज्य में 'जानकारी' नाम से की गई सरकारी व्यवस्था के तहत टेलीफ़ोन पर आवेदन स्वीकार किया जाता हो.

जहाँ मांगी गई सूचना इतने आसान तरीक़े से उपलब्ध कराने की पहल की गई हो, वहाँ अब सूचना के अधिकार की ऐसी दुर्दशा को अरविंद केजरीवाल ने बड़ा ही दुर्भाग्यपूर्ण कहा है.

इस क़ानून के प्रावधानों की सही समझ अभी पूरी तरह न तो लोक सेवकों में है और न ही सूचना मांगनेवाले लोगों में. सबकुछ दुरुस्त होने में कुछ वक़्त लगेगा. जहाँ तक प्रताड़ना कि बात है तो ऐसी निश्चित और सही शिकायत अगर आयोग को मिलेगी तो उसे कार्रवाई के लिए सरकार के पास ज़रूर भेजा जाएगा

दूसरी ओर शिकायतों की भरमार से घबराए मुख्यमंत्री ने कुछ फौरी कार्रवाई के निर्देश दिए हैं.

इसी सिलसिले में उन्होंने एक हेल्पलाइन नंबर- 2219435 जारी करते हुए ख़ुद टेलिफ़ोन पर पहली शिकायत (संख्या 001) दर्ज कराई.

टेलिफ़ोन पर मुख्यमंत्री ने लिखाया- मुख्यमंत्री सचिवालय को सूचना मिली है कि वीरेंद्र महतो, ग्राम- कसियोना, पंचायत- करैया पूर्वी, प्रखंड- राजनगर, ज़िला- मधुबनी द्वारा करैया के प्रखंड आपूर्ति पदाधिकारी से जन वितरण प्रणाली की दुकानों में राशन- किरासन आपूर्ति का ब्यौरा माँगा गया था. इस पर उनको धमकी दी गई, जो राजनगर पुलिस थाना में केस संख्या 181/09 दिनांक 10-08-09 दर्ज किया गया है. इस मामले की पूरी जांच करके मुख्यमंत्री सचिवालय को सूचना दी जाए.

समझा जा सकता है कि मुख्यमंत्री ने सार्वजनिक तौर पर एक नरम किस्म की ही शिकायत दर्ज कराई. गंभीर किस्म की शिकायतें तो आम लोगों के बीच जाने पर मिलती हैं.

कहीं मुखिया और पंचायत सेवक, तो कहीं प्रखंड, अनुमंडल और ज़िला स्तरीय पदाधिकारी सरकारी योजना राशि में लूट मचाते हुए मिलते हैं.

लेकिन इन्हें पकड़ेगा कौन? सब जानते हैं कि नीचे से ऊपर तक का सरकारी महकमा लूट में शामिल रहता है.

शिकायत

ऐसे में सूचना के अधिकार के तहत कोई आम आदमी अगर घोटाले का राज़ खोलने वाली जानकारी मांगेगा तो लुटेरों के बीच खलबली होगी ही.

परवीन अमानुल्लाह की राय

अगर कोई आम आदमी सूचना पाने के अपने हक़ का डटकर इस्तेमाल करना चाहता है तो उसे डरा-धमका कर ख़ामोश करानेवाले सरकारी अधिकारी फ़ौरन सक्रिय हो जाते हैं. इसलिए दोषी पाए जाने पर भी उन पर सख़्त कार्रवाई नहीं होती. मैंने 45 ऐसे मामलों की जानकारी राज्य सरकार को बहुत पहले दी थी, लेकिन उस पर अब तक कुछ भी नहीं हुआ

राज्य के मुख्य सूचना आयुक्त अशोक कुमार चौधरी फिर भी नहीं मानते कि कोई लोक सूचना पदाधिकारी किसी सूचना माँगने वाले को जेल भेजने की धमकी देता होगा या किसी सरकारी फ़ाइल को ग़ायब करता होगा.

लेकिन उन्होंने कुछ शिकायतों को स्वीकार करते हुए कहा, "इस क़ानून के प्रावधानों की सही समझ अभी पूरी तरह न तो लोक सेवकों में है और न ही सूचना मांगनेवाले लोगों में. सबकुछ दुरुस्त होने में कुछ वक़्त लगेगा. जहाँ तक प्रताड़ना कि बात है तो ऐसी निश्चित और सही शिकायत अगर आयोग को मिलेगी तो उसे कार्रवाई के लिए सरकार के पास ज़रूर भेजा जाएगा."

सूचना अधिकार मामलों से जुड़ी एक गैर सरकारी संस्था की प्रमुख परवीन अमानुल्लाह का कहना है कि भ्रष्ट सरकारी अफ़सरों और कर्मचारियों का ऐसा गिरोह बन गया है, जो इस क़ानून को बेअसर बनाने पर तुला हुआ है.

पिछले दिनों सूचना अधिकार पर एक सम्मेलन भी हुआ

यहाँ उल्लेखनीय है कि परवीन अमानुल्लाह बिहार के एक बड़े आईएएस अधिकारी अफज़ल अमानुल्लाह की पत्नी हैं.

इन्होंने एक भेटवार्ता में बीबीसी से खुलकर कहा कि राज्य की शासन व्यवस्था में भारी गड़बड़ी है और यहाँ अधिकांश नौकरशाह भ्रष्ट हैं.

मुख्यमंत्री नीतीश कुमार अपने भाषणों में ज़रूर कहते हैं कि लोकतंत्र में जनता ही मालिक है और मालिक की मांगी गई सूचना नहीं देने वाले नौकर यानी अधिकारी बख्शे नहीं जाएँगे.

लेकिन होता है उल्टा. प्रताड़ित जनता हो रही है और नेता-अधिकारी फल-फूल रहे हैं.

बिहार में सूचना मांगने वालों को प्रताड़ित करने की काफी शिकायतें आ रही हैं। अब बिहार सरकार ने सूचना पाने के नियमों में अवैध संशोधन करके एक आवेदन पर महज एक सूचना देने का नियम बनाया है। अब गरीबी रेखा के नीचे के लोगों को सिर्फ दस पेज की सूचना निशुल्क मिलेगी, इससे अधिक पेज के लिए राशि जमा करनी होगी। ऐसे नियम पूरे देश के किसी राज्य में नहीं हैं। ऐसे नियम सूचना कानून विरोधी हैं। इससे सूचना मांगने वाले नागरिक हताश होंगे। इससे नौकरशाही की मनमानी बढ़ेगी। इस तरह बिहार सरकार ने सूचना कानून के खिलाफ गहरी साजिश की है। अगर सूचना पाने के नियमों में संशोधन हुआ तो नागरिकों को सूचना पाने के इस महत्वपूर्ण अधिकार से वंचित होना पड़ेगा। एक समय बिहार को आंदोलन का प्रतीक माना जाता था। आज सूचना कानून के मामले में बिहार पूरे देश में सबसे लाचार और बेबस राज्य नजर आ रहा है। वहां सुशासन की बात करने वाले मुख्यमंत्री नीतीश कुमार ने दुशासन की भूमिका निभाते हुए कुशासन को बढ़ाना देने के लिए सूचना कानून को कमजोर किया है।

Bihar ranks 10th on RTI parameters

PATNA: Although Bihar has earned laurels at the national level for taking the initiative to provide information under the RTI Act besides establishing Jankari call centre, the state is placed tenth in the country with regard to RTI parameters. There are 28 informtion commmissions in the states and one at the Centre with altogether 94 information commissioners. Bihar is far behind Karnataka, Kerala, Punjab, Orissa, Assam and four other states but ahead of West Bengal, Andhra Pradesh, Maharashtra and other states. This has been revealed in a survey conducted by the National RTI Awards Secretariat to assess the performance of information commissions across the country for National RTI Awards 2009. It is based on the feedback from 6,000 people. As far as overall public satisfaction with the commssions is concerned, Bihar has been given 31% compared to 55% to Karnataka and 52% to Kerala. The finding said the national average of getting information under RTI is 27%. These findings were released on Thursday by the Bihar Right to Information Manch. The Secretariat also analyzed 51,128 orders passed by the information commissioners. Of the cases in which orders were passed, only two per cent of the officials were penalized. "If an officer does not provide information under the RTI Act, despite an order from the information commission, there is two per cent chance that he would be penalized," the finding said. There are 23 commissioners who have virtually never imposed any penalty for non-disclosure. Bihar's two information commissioners Shakeel Ahmad and P N Narayanan have been placed at 30th and 33rd position respectively on effectiveness parametre and the same ranking in imposing penalties.
